HC directs Chief Judicial Magistrate to make necessary inquiry in matter of assault of an advocate in Etah
The Allahabad High Court has taken suo moto cognizance of the incident of Etah where the UP police had brutally beaten and dragged an advocate and his family members too.
The Division Bench of High Court comprised of Chief Justice Govind Mathur and Justice aumitra Dayal Singh while acknowledging the letter send by High Court Bar Association has directed the Chief Judicial Magistrate for the enquiry of the matter and submit a complete report till next date.
The court after considering the facts of present matter stated that,
“We deem it appropriate to have a complete report of the incident through Chief Judicial Magistrate, Etah. The Chief Judicial Magistrate, Etah is directed to make a necessary inquiry by availing all relevant facts including audio visual electronic documents and submit to this Court on or before next date of listing.”
The apex statutory body of the Advocates of the State of Uttar Pradesh; the Bar Council of Uttar Pradesh has addressed a letter to the Chief Justice of this Court with a request to take appropriate action in relation to an incident said to have taken place at Etah. It was submitted before the court that Sri Rajendra Sharma, a practicing Advocate at Etah was beaten and manhandled by the police and his relatives too were harassed and humiliated.
The court has also directed to Senior Superintendent of Police, Etah to co-operate with the Chief Judicial Magistrate, Etah and they shall supply all relevant facts and documents as desired by the Chief Judicial Magistrate.
The court has listed the present matter on 8th January for next hearing.
